Terms of Service

1. Agreement

By using HAT2AI (https://creatadv.online), you agree to these Terms of Service. If you do not agree, please do not use the service.

HAT2AI is a product of CreatADV SMPC ("Company", "we", "us", "our").

2. Service Description

HAT2AI is a digital marketing intelligence platform. Available modules include:

• Traffic Analytics: Server traffic analysis
• SEO Audit: Automated search engine optimization checks
• AI Visibility: Assessment of visibility across AI platforms
• AI Monitoring: Tracking business mentions on ChatGPT, Gemini, Claude, Perplexity
• Google Business Profile Reviews: Google review management
• AI Review Manager: AI-powered automated review responses
• Ads Intelligence: Meta, Google, TikTok, LinkedIn Ads analytics
• AI Chatbot: Embeddable AI-powered chatbot for client websites
• AI Room Assistant: AI room assistant for hotels
• Hotel AI Video: AI video creation for hotels
• AI Shop Manager: AI-powered e-shop management (WooCommerce)

Services are provided on a subscription basis with setup fees and monthly recurring fees.

3. Account & Access

• Accounts are created by CreatADV for authorized clients
• You are responsible for maintaining the confidentiality of your credentials
• One account per authorized user; sharing credentials is prohibited
• CreatADV may suspend or terminate accounts for violation of terms

4. Subscriptions, Payments & Refunds

4.1 Product Types

We offer three product types:

• Setup products — one-time payment, lifetime access (e.g. QRx Standard Setup, AI Visibility Setup)
• Subscription products — 1 / 3 / 6 / 12-month periods with progressive discounts (5% / 10% / 15% respectively)
• One-time products — single purchase of service/deliverable (e.g. Hotel AI Video)

4.2 Payment Processing

• All electronic payments are processed by Stripe Payments Europe, Ltd., a PCI-DSS Level 1 certified payment processor. CreatADV does not store or have direct access to your card details.
• Accepted methods: Visa, Mastercard, American Express, Apple Pay, Google Pay, and selectively SEPA direct debit.
• Alternatives: bank transfer or invoice via formal order.
• Currency: all prices in Euro (EUR). Currency conversion is performed by your bank.
• Non-payment may result in service suspension.
• We reserve the right to decline or cancel orders showing signs of fraud.

4.3 VAT & Invoicing

VAT is calculated based on your billing country:

• Greece: 24% VAT
• Other EU countries (B2B with valid VAT): 0% VAT — reverse charge, Art. 196 Directive 2006/112/EC
• Outside EU: 0% VAT — export of services, Art. 14 Greek VAT Code

Stripe issues an automated payment receipt. The formal invoice (per Greek law and myDATA) is issued by us manually within 2 business days of payment and sent via email.

4.4 Refund Policy

• Refund window: You may request a refund within two (2) business days of purchase by emailing info@creatadv.com with your order number.
• After 2 business days: Payments are non-refundable, as our services are activated automatically upon payment and consume billable API resources.
• Full refund: We refund the full amount paid (including VAT) via the original payment method. Credit to your bank typically takes 5-10 business days.
• Partial refunds (cancelling mid-period) are not supported except in exceptional circumstances.
• Exceptions — no refunds for:
  • Orders where the service has been substantially consumed (e.g. Hotel AI Video where deliverable was produced).
  • Setup products after our team has begun the configuration process.
  • Purchases older than 2 business days.
• Chargebacks: If you file a chargeback without prior communication with us, your account will be immediately suspended and we may pursue legal action. Please reach out first — nearly all disputes are resolved amicably.

4.5 No Auto-Renewal

IMPORTANT: Our subscriptions do NOT auto-renew. At the end of the period you will receive reminder emails (30 days and 7 days before expiry) to actively renew. If you do not renew, the service will be deactivated automatically.

• Data retention after expiry: Your data is retained for 90 days before permanent deletion, giving you time to renew without data loss.
• Annual-only products: Certain products (e.g. Full Property Bundle Whitelabel) are sold only with a 12-month annual commitment. This is clearly stated on the purchase page.
• Setup before subscription: Some services require an initial setup (billable one-time) before the subscription can be activated. This prerequisite is shown at checkout.
• Pricing changes: We reserve the right to change our prices for future orders (with 30 days notice). Existing subscriptions remain at the original price until expiry.

5. API Keys & Third-Party Services

• BYOK (Bring Your Own Key): Clients who provide their own API keys are responsible for their own API costs
• CreatADV is not responsible for third-party API outages, changes, or costs
• Managed API option: CreatADV provides API access at cost + 30% markup

6. Data & Privacy

• See our Privacy Policy
• Client data remains the property of the client
• CreatADV does not claim ownership of client data
• Upon subscription cancellation, data is retained for 12 months then deleted

7. AI-Generated Content

• AI recommendations, ad copy, review replies, and chatbot responses are generated by artificial intelligence
• CreatADV is not responsible for the accuracy or outcomes of AI-generated content
• Clients should review all AI-generated content before publishing or acting upon it
• AI review replies require human approval before posting to Google (per Google policy)

8. Chatbot & Widget

• The chatbot widget is embedded on client websites via JavaScript
• CreatADV is not responsible for visitor data collected through the chatbot beyond what is described in the Privacy Policy
• Clients are responsible for informing their website visitors about the chatbot's data collection (cookie/privacy notice on their own website)

9. Intellectual Property

• HAT2AI platform, code, design, and branding are the property of CreatADV SMPC
• Whitelabel editions remove CreatADV/HAT2AI branding but do not transfer IP rights
• Clients may not reverse engineer, copy, or redistribute any part of the platform

10. Limitation of Liability

• Services provided "as is"
• CreatADV is not liable for indirect, incidental, or consequential damages
• Maximum liability limited to fees paid in the last 3 months

11. Governing Law

These terms are governed by the laws of Greece. Disputes shall be resolved in the courts of Athens, Greece.
